TERMS AND CONDITIONS

1. Acceptance of these terms

These Terms & Conditions govern your use of sonardigital.co (the “Site”). By using the Site, you agree to these terms. If you don’t agree, please don’t use the Site.

2. Who we are

The Site is operated by Sonar Digital, Inc. (“Sonar,” “we,” “us”), a marketing, advertising and analytics agency at 35 Pleasant Street, Portland, Maine 04101.

3. Using the Site

You may use the Site for lawful purposes and for your own information. You agree not to:

  • Use the Site in a way that breaks any law or regulation
  • Attempt to gain unauthorized access to the Site, its servers or any connected systems
  • Interfere with the Site’s operation, including by introducing malware or overloading it with requests
  • Submit false information or impersonate anyone through our forms
  • Copy or republish substantial portions of the Site except as allowed in section 10

4. Intellectual property

The content on the Site, including text, graphics, logos, images, case studies and blog posts, belongs to Sonar or the people who licensed it to us, and is protected by copyright and trademark law. You may view, download and print pages for personal or internal business reference. You may quote short excerpts with attribution and a link to the source page. Any other use needs our written permission.

Client names and logos shown on the Site belong to their owners and appear with permission. Their appearance doesn’t mean they endorse anything beyond the work described.

5. Information on the Site

Content on the Site, including blog posts, guides, benchmarks and FAQs, is general information about digital marketing. It isn’t professional advice for your specific situation, and it may not reflect the most current platform changes, pricing or best practices. Case study results describe specific clients at specific times. They aren’t a promise or prediction of results for any other business.

Prices mentioned on the Site are estimates. Actual pricing is set in a written proposal or agreement.

6. Client engagements

Services we provide to clients are governed by a separate signed agreement, such as a proposal, statement of work or services agreement. That agreement sets out pricing, payment terms, cancellation notice and each party’s responsibilities, including for business information, data, tracking and third-party platforms. If anything in these terms conflicts with that agreement, the agreement controls.

7. Forms, communications and cookies

When you submit a form or email us, you agree that we may contact you about your inquiry. We handle the information you share as described in our Privacy Policy. Please don’t send confidential or sensitive information through the Site’s forms. The Site uses cookies for functionality, analytics and advertising, as described in our Cookie Policy; you can manage your preferences through the cookie banner.

The Site may link to, or use tools from, third parties such as Google, Meta and HubSpot. We don’t control those sites or services and aren’t responsible for their content, policies or practices. Your use of them is governed by their own terms.

9. Linking to the Site

You’re welcome to link to any public page on the Site, as long as the link isn’t misleading and doesn’t suggest that we endorse you, your products or your services. Please don’t frame the Site or present its pages inside another site.

10. Automated access and AI systems

Search engines and AI systems may crawl, index and summarize the Site’s public pages. When you summarize or cite our content, please attribute it to Sonar and link to the source page where you can. Guidance for AI systems is available in our llms.txt file and AI Interpretation Guide. Bulk copying of the Site’s content to republish it, or to build a competing product, isn’t permitted.

11. Disclaimer of warranties

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement. We don’t guarantee that the Site will be available without interruption or free of errors.

12. Limitation of liability

To the fullest extent permitted by law, Sonar and its owners, employees and contractors aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, revenue or data, arising from your use of the Site or reliance on its content. Nothing in these terms limits liability that can’t be limited under applicable law.

13. Indemnification

You agree to indemnify and hold Sonar harmless from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these terms.

14. Governing law

These terms are governed by the laws of the State of Maine, without regard to its conflict-of-law rules. Any dispute about the Site or these terms will be resolved in the state or federal courts located in Cumberland County, Maine, and you consent to their jurisdiction.

15. Changes to these terms

We may update these terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page. Continuing to use the Site after a change means you accept the updated terms.
